Medical Malpractice - Rumph Childers, LLC

Representing medical negligence victims in middle Georgia and across the state including Macon, Warner Robins, Perry, Eastman, Dublin, Atlanta, Augusta, Savannah, Albany, and Valdosta.

Recent studies suggest that deaths due to medical errors result in over 98,000 deaths annually in the United States, which makes medical negligence the third leading cause of death in the U.S. behind cardiovascular disease and cancer. This means that more people are killed each year due to medical negligence than car accidents, breast cancer, and AIDS. It is estimated that annually $17-$30 billion dollars are spent trying to correct these mistakes. In fact ABC News recently reported that hospitals make three times as much money when errors do occur. Earlier, The Journal of the American Medical Association even expressed concern over the quality of American healthcare.

According to CNN, the top 10 medical mistakes are:

  1. Treating the wrong patient because proper identity was not confirmed prior to treatment;
  2. Leaving surgical devices or equipment like sponges in the patient before closing the surgical site in surgery;
  3. Losing patients who are apt to wonder from the hospital unsupervised;
  4. Practicing medicine without a proper license;
  5. Delaying time critical treatment in the emergency room;
  6. Allowing air bubbles to form in the blood supply;
  7. Operating on the wrong body part;
  8. Allowing circumstances to give rise to avoidable infections;
  9. Mistaking the identity of critical care tubes; and,
  10. Failing to administer the proper anesthesia.

As patients, we assume that when we arrive for medical care, experts that are properly trained and fully aware of our medical needs are paying close attention and providing proper medical care. Unfortunately, this is not the case for as many as 20-30% of patients that receive medical care not called for by their symptoms, injuries, or illnesses.

Physicians and health care organizations, like hospitals, are responsible for adhering to a minimum standard of care for their patients. If this standard is not met, and a patient suffers as a result, then the health care provider should be held responsible for the harm caused. This professional liability is commonly termed medical negligence or medical malpractice.
